1. Company Identity

FitPesa Ltd (Nigeria) is the operator of the FitPesa application. Avalanche Internet Solutions (Uganda) is the developer and technology partner.

2. Eligibility

Users must be 18 years or older to access dating and video features. By using the App, you represent and warrant that you meet this age requirement.

3. Account Use

Users must provide accurate information when creating an account. The following activities are strictly prohibited:

• Creating fake accounts or impersonating others
• Harassment of other users
• Engaging in illegal activity through the App
• Sharing false or misleading information

4. Tokens

Tokens are in-app rewards, not legal tender. They function as digital loyalty rewards within the FitPesa ecosystem.

Earning limits, redemption rules, and token value may be updated at any time to maintain economic stability and prevent fraud. Tokens are not money, securities, or deposits, and should not be treated as investments.

5. Ads & Revenue

FitPesa generates revenue from advertisements, videos, and sponsored tasks. By using the app, you agree to see ads as part of the user experience. Ad content is provided by third parties, and FitPesa is not responsible for the accuracy or quality of advertised products or services.

6. Marketplace (PesaMarket)

PesaMarket facilitates peer-to-peer transactions between users. All transactions are at the users' risk.

FitPesa may provide escrow services to facilitate safe transactions, but we disclaim liability for disputes, product quality, delivery issues, or fraud between buyers and sellers. Users are responsible for vetting sellers and products before making purchases.

7. PesaChat & FitLovers

Users must behave respectfully in all communications. The following conduct is prohibited:

• Harassment or bullying of other users
• Hate speech or discrimination
• Illegal use of messaging features
• Solicitation or spam

FitPesa disclaims liability for user conduct. Any offline meetings arranged through the app are entirely at the users' own risk. FitPesa is not responsible for any harm, disputes, or issues arising from in-person encounters between users.

8. Fraud & VPNs

FitPesa employs AI-based fraud detection systems to maintain platform integrity. The following activities may result in immediate account termination:

• Use of VPNs to manipulate location or earn rewards fraudulently
• Use of bots or automated scripts
• GPS manipulation or spoofing
• Emulator use to simulate physical activity
• Any other fraudulent activity

Appeals may be considered at FitPesa's sole discretion. Decisions regarding fraud and account termination are final.

9. Termination

FitPesa reserves the right to suspend or terminate accounts at any time for violations of these Terms, fraud, suspicious activity, or for any other reason deemed necessary to protect the platform and its users.

10. Jurisdiction

This agreement is governed by Nigerian law.

U.S. Users: Are subject to binding arbitration with the American Arbitration Association (AAA) for dispute resolution.

EU/UK Users: Remain under Nigerian law but retain EU/UK data protection rights as outlined in our Privacy Policy.

11. Modification of Terms

FitPesa may update these Terms at any time. We will notify users of material changes via email or in-app notification. Continued use of the app after changes are posted constitutes acceptance of the modified Terms.
